Hello sir, iam working in a pvt organization which works for five days a week ,so based on the Gratuity act will i get the gratuity for working for 4 years and 7 months , the organization says it is 4 years and 8 months only and it is not agreeing to give gratuity , please advice

Some of the Hon'ble High Courts says that, if employee worked 4 years 6 months service, it deemed to be 5 years of service. Hence he is eligible for his claim Gratuity before the Controlling Authority, Asst. Commissioner of Labour, the limitation is 90 days from the date of resignation or releaving from the company. before filing the case, prior notice is mandatory.

Hello Venkatesh, to get the Gratuity the minimum criteria work period is five years. In your case five years not completed, so you cannot get. This condition relaxed only if the employee died or disabled, in such an event only below five years considered.
